Terms of Service

1. Agreement to Terms

By downloading, installing, or using the Album mobile application (the “App”) operated by Nexus Kairos LLC (“Company,” “we,” “us,” or “our”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the App.

2. Description of Service

Album is a photo organization and cleanup application that allows users to review, organize, delete, and manage their photo library. The App uses on-device AI to detect duplicate photos, blurry photos, screenshots, large files, and similar photos to help users reclaim storage space. All processing is performed locally on the user's device.

3. Eligibility

You must be at least 13 years old to use the App. By using the App, you represent and warrant that you are at least 13 years of age. If you are under 18, you represent that you have your parent or guardian's permission to use the App.

4. Photo Library Access and Permissions

Album requires access to your photo library to function. By granting this permission, you authorize the App to read and display your photos for organizational purposes. The App only deletes photos at your explicit instruction. Deleted photos are moved to your device's “Recently Deleted” folder and can be recovered within 30 days. You are solely responsible for any photos you choose to delete using the App.

5. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose or in violation of these Terms
• Attempt to gain unauthorized access to the App or its related systems
• Reverse engineer, decompile, or disassemble any aspect of the App
• Reproduce, duplicate, copy, sell, or resell any portion of the App
• Interfere with or disrupt the integrity or performance of the App

6. Subscriptions and Payments

Certain features of the App require a paid subscription or one-time purchase. All purchases are processed through the Apple App Store. By purchasing a subscription:

• Payment will be charged to your Apple ID account at confirmation of purchase
• Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current billing period
• Your account will be charged for renewal within 24 hours prior to the end of the current period
• You can manage and cancel subscriptions in your Apple ID Account Settings
• No refunds are provided for partial subscription periods

7. Free Tier Limitations

The free version of Album includes a limited number of photo reviews per day. Upgrading to Album Pro removes daily limits and unlocks all features. Feature availability is subject to change with reasonable notice.

8. Intellectual Property

The App and its original content, features, and functionality are owned by Nexus Kairos LLC and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes.

9. Disclaimer of Warranties

THE APP IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES. WE ARE NOT RESPONSIBLE FOR ANY ACCIDENTAL DELETION OF PHOTOS. ALWAYS MAINTAIN BACKUPS OF IMPORTANT PHOTOS BEFORE USING THE APP.

10. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall Nexus Kairos LLC, its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation loss of data, resulting from your use of or inability to use the App.

11. Termination

We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the App will immediately cease.

12. Governing Law

These Terms shall be governed and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.

13. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. By continuing to use the App after revisions become effective, you agree to be bound by the revised terms.
